Million Dollar Decision for the City of Patterson

City of Patterson Recoups up to $1,000,000 in Long-Awaited Court Decision

SACRAMENTO, May 8, 2015 – The City of Patterson received a favorable Statement of Decision on April 22, 2015 in a lawsuit between Patterson Hotel Associates, LLC (PHA) and the City of Patterson.

“The tentative ruling is now final. As previously decided, the court again found that the City is owed $237,147.86 plus interest for unpaid taxes from Patterson Hotel Associates. Regarding the Hotel’s various claims in the amount of approximately $4,000,000.00, the court reiterated that the City owes them nothing.” stated Tom Hallinan, City Attorney for the City of Patterson. “Since we prevailed in every aspect of the case, the judge determined that we are entitled to reimbursement for attorney’s fees and costs such as expert witness expenses. In total, we are potentially entitled to receive up to $1,000,000.00 from Patterson Hotel Associates for fighting and winning this case on behalf of the taxpayers of the City of Patterson.” Hallinan added.

The City of Patterson’s argument against PHA’s claims state that any previous agreements regarding reimbursement were with the county, when the project area was within the county’s jurisdiction, and don’t pertain, since the city annexed the land in 2004.
